引 言 泰国的土地登记证主要分为4种类型,每种登记证体现的权属性质不同,对不动产的买卖、租赁等会产生显著影响。 因此,若外国投资者拟对某块土地进行交易时,需对该土地的登记证书予以仔细核查,以免增加境外投资的法律风险和商业风险。 01 各类土地登记证简介 1. 红色土地登记证 红色加鲁达印章用于土地所有权登记证书,该证书是最明确的所有权文件,其所记载的土地可用于买卖和转让。应注意,如果他人公开且连续占用某块土地10年,其可能会在此期间经过后获得对该土地的权利。 部分红色加鲁达土地登记证称为红背证书,该类证书背面可能会注明5-10年内不允许转让。我们建议外国投资者仔细检查这些文件的背面,确认是否以红色墨水注明在指定期限内不允许转让。 此类红色登记证下的土地,在转让禁令期间无法进行交易或办理转让登记,但可以用作贷款的担保。然而,该类土地难以申请法律强制执行。如果债务人违约,债权人无法强制债务人在转让禁令期间转让该土地。 2. 绿色土地登记证 [...]
