1.2 Application for FBL/FBC and BOI Licenses
FBL/FBC
Thai authorities grant permission to foreign investors to conduct certain business under certain conditions by issuing the Foreign Business License (FBL) or Foreign Business Certificate (FBC).
BOI
In order to promote the economic development in Thailand, motivate foreign investment and attract high technology, the Thailand Board of Investment (BOI) enacted a series of preferential investment policies. Qualification to and level of the investment incentives are subject to factors such as the specific industry, investing zone, business scale, output value, etc.

- Provide suggestions and guidelines on FBL/FBC/BOI application via analyzing and consulting with Officer based on specific investing background;
- Assist and provide guidance on preparing application documents;
- Assist to state application reason to Officer, introduce and interpret the investment project;
- According to Officer’s feedback, assist to answer the questions and to revise the application documents;
- Based on procedures, assist to arrange an interview with the Officer;
- Provide advice on BOI compliance and assistance on such BOI inspection.
1.3 Business – specific licenses：
Companies conducting certain business shall obtain special licenses according to relevant Thai laws and industry regulations. Type of license, requirements and application procedures depend on specific situation. TP & Associates can provide legal advice and assist on the license application to companies engaging in (including but not limited to) the following business based on client’s demands.

- Real estate and construction industry

- Factory license
Factories in Thailand are classified into 3 main categories depending on the machinery’s horsepower, number of workers employed, likelihood of pollution, level of environmental protection concerns, etc. This classification determines whether a factory requires a license.
- Restaurants & bars
Sale of food and beverages is categorized in Annex 3 of the Foreign Business Act, and therefore foreigners who wish to open a restaurant in Thailand must apply for (a) FBL, and (b) licenses related to the restaurant business. Specific licenses depend on the services offered.
- FDA Licenses
Companies conducting manufacturing, sales or import of pharmaceuticals, health care products, cosmetics and medical appliances in Thailand shall obtain special licenses and/or complete registration, including manufacturing license, import license, product registration, sales license, factory set-up license, etc.
